I noticed a post from someone from the Phantom of the Opera, probably Stage Manager, shaming a person for falling asleep in the front row. And posting a photo of the said person. Is that ok in the UK? Is that legal???
‘Cause I really wouldn’t love my pictures being shared that way, if I’m not doing smth that theatres do not allow, like, using mobiles. Although probably I wouldn’t be ok if my photo was shared in that case as well (and I never use mobile during the show)
And yes, I did fell asleep in the theatres. When you have a 5:45 alarm, working day, packing and leaving home at about midnight UK time and then seeing a show next evening with 3 hour time difference (meaning it is me awake for 24+ hours after just a couple of hours of sleep the night before and at the time I’m not awake in Moscow). I can’t say I’m proud of it but not ashamed also. It just happened. And I would be ok if someone in the wings ir in stage noticed and laughed privately. But not if they share it on twitter like that!

You can legally challenge a photo being taken and published without your consent where you have a reasonable expectation of privacy - ie your bedroom, a public toilet, a private garden etc. Nowhere in public spaces counts and I doubt a theatre would either.
Whether it's ethically ok is another matter of course.

I think it's not OK - they have no idea what kind of day the man had. I've found myself nodding off on occasion, too.
And once I was hit by a terrible migraine while sat in the front row of a play I had REALLY been looking forward to see, so I sat with my eyes closed for longer stretches and left in the interval because I just had to lie down. No one was sadder than me that I basically hardly saw the play at all. To then be mocked on Twitter would just be the icing on the cake.

If the poster is a member of PotO staff then they should be disaplined. Not only have they shown a lack of disrespect for a patron but also suggested the product is a snooze fest

We’ve all had those moments when we’re simply too tired and drift off. It’s funnier when it’s someone in the middle of the front row precisely because you assume that they really wanted to see the show. Especially as he gave an enthusiastic standing ovation for a show he slept through!
No, she shouldn’t really have taken and shared the photo on an open SM platform - this is the sort of thing Facebooks is for, so you can share it with just your friends and not the general public - but a theatre is a public place, so there’s nothing illegal about it.
You have almost certainly drawn more attention to it and given it a wider audience by tweeting about it and posting about it here than her original tweet, though. So if you’re really that concerned about the privacy of the guy in the photo, you should probably delete your tweet and remove the link in this thread.

According to the copyright course I attended for work if a photo is taken specifically of you then you own what's called 'the moral copyright' and would have the right to sue.
Of course, if the tickets/terms conditions have that handy disclaimer that by attending you are agreeing to possibly having your photo taken during the evening and used then you've given that away and they can do as they please.
It then depends on the morality and discretion of the theatre - looks like there isn't much of that at Her Majesty's unless someone makes that FOH person take it down and apologise.

Reposting the screenshot is legally iffy: the copyright is owned by person who took the original picture.
As for taking the photograph in the first place, you can photograph anyone you like so long as you're not invading their privacy. As I understand it, however, if the way you use the picture could cause them harm or damage their reputation then they can sue you unless you've obtained their permission in advance, typically by way of a model release.

Slightly off subject but you know when there is a news item about obese people in the UK, they often show large people walking along the street. They never show their faces but I am sure if you were one of the people being filmed you would recognise yourself. Is that allowed without their permission as I'm sure that would cause them harm and damage their reputation.

Poor guy.
People can fall asleep during a show for one of many reasons - they could be jetlagged, have insomnia, have a medical condition, are bored by the theatre but kindly agreed to take their family as a treat but couldn't manage to stay awake....There was a thread elsewhere about how expensive tickets for Phantom were, so imagine paying top dollar and then being ridiculed.

That’s the definition of a public place - where any member of the public can see you and you have no reasonable expectation of privacy. And there’s nothing about being shown to be obese in public that can be considered reputational damage by a court, if it’s a true statement.

A few things- SM can use phones as much as any of us at work. No technically they probably shouldn't (as any of us at work) but also depending on the show, they also have moments of 'down time' as well where they're not busy....the rules for that are with individual employers as the rest of us. Likewise tweeting ABOUT the workplace from the workplace etc. That's their employer's call really. Should they (morally) have tweeted the picture? probably not. If I were them, as kathryn says above I'd probably text it/DM it to some friends for the lols (as the kids say) and maybe post on FB if I had it set pretty private. If I were the SM would I have tweeted something (without picture) in all honesty probably...because it's a bit funny, a bit of a venting frustration. And without a picture nobody but the fella in question and his neighbours would know. As for falling asleep, yeah we've all probably done it, but to be fair it is a BIT more embarrassing/public if you're front row centre while you do it...

I have sometimes struggled against it (most recently in The Best Man) but have never actually fallen asleep in the theatre. I would say though that if someone, for whatever reason. falls asleep and starts snoring loudly they should be politely asked to leave. However understanding one is, the right of the rest of the audience to enjoy the play should not be affected.

This is one of those stories where I desperately want to know the outcome but suspect I never will. Did the member of the public get an apology? Did anyone face disciplinary action? The Internet is filled with these half-told stories, a million tales with the last chapter never written.

My view is that if people on stage don't want people to fall asleep, they should be more entertaining Anyway ... looks like the original tweet was deleted (I can't find it anyway) so ironically the only copy of the photo is Stasia's screenshot of it!

I draw a distinction between people falling asleep at the theatre (OK) and people falling asleep and snoring at the theatre (not OK).
There are some countries where if you are presenting to a room full of people you can almost guarantee some of them will fall asleep no matter how engaging you are - Japan is one (it’s related to their long working hours culture and often high commuting times) - never been to the theatre there but I can imagine what it’s like.
