How is that injury the producer's fault? How many times had ge performed that scene without falling off the ladder? I agree that he deserves some compensation, but actively blaming the producers for an accident seems strange.

Well, as the adverts say, have you been involved in a road accident that wasn't your fault ? This just sounds like a no win no fee attempt by personal injury lawyers to get some money out of the producers' insurance company. |

I always 🙄 inwardly when there’s a scene where an actor goes up about two feet on some sort of prop, and we have the whole rigmarole of them being buckled into a safety harness beforehand. But of course, this is the reason why.

Why would a broken ankle rule someone out from performing leading roles? Unless you are auditioning to play Electra in Starlight Express.
David Birrell only got £250k when he was blinded in one eye in the Donmar Warehouse production of Passion, when a prop gun malfunctioned. Now I would say that is a more career threatening injury, as well as being a completely awful thing to happen. I was surprised how low the compensation was.

As with Jade Ewan, I really can't imagine anything coming from this. It would seem to be a stronger case than hers, but surely they'd require evidence that the reason he isn't getting parts is due to a lack of mobility. That would require statements from casting directors saying "we wanted to cast him for a show at £200k per contract for the next 10 years, but we couldn't because of his ankle". Which seems unlikely to happen.

My guess is it will be settled out of court for a fraction of what is being asked, the insurance company will base their decision on what their legal fees might be to fight it. |

It’s a bit of a high risk strategy, going public to say you can never take a leading role again and relying on the million quid coming through. He’ll never get a million and let’s say they settle on 100k… then what? He’s kyboshed his future career.

I gave this some thought on the way home tonight and think that Ben Forster could do very well financially out of this and could even win the whole amount he is suing for, if it can be demonstrated that the producers’ showed total disregard for Elf & Safety.

Someone was injured on stage during Henry V the other night. Slipped on all those little rubber bits of grit. The show was stopped and the understudy was swapped in. Got to be be worth £10k ?

For completeness the case view is below. I'll keep an eye open for the actual trial as it'll be open to the public. It might be slightly tricky to enforce a judgment debt against a company that's in liquidation so I would assume the 2nd defendant will be in the firing line. It's not too uncommon for theatre companies to end up in court...I understand the popular hire company White Light was involved in a personal injury claim at the High Court initiated by a former apprentice in 2019. The claim was discontinued in June last year. It's fair to say White Light were defending the claim and should be assumed to have committed no wrong-doing.  |
